i recently kinda dropped out of school to take online classes until next year, but not for any particular reason and i was told that a teacher of mine told every single one of her classes that the reason i did that is because i have mono. can she do that? thats ok for her to do?

there is a thing as defamation of character.
People spreading lies about other people and discrediting them.
Ive only seen it in the work place, and not at school, but you could tell the principal, and even take it up to the superintendent or board of education for the region if its really bothering you.

Mono's not such a bad thing, it would be different if she said you had an STD, but it could still be percieved as negative.
If it bothers you much, report it.

I don't know of any law that prevents her from doing that. However, her comments are definitely unethical. Your school may have a policy preventing her from discussing your health. Can you prove the teacher actually said you have mono? If so and if the school has some kind of privacy policy, you can take action. Notify her superior about her inappropriate comment. If that doesn't help work your way up the chain. Good luck!

File a complaint with the manager. Since I'm sure they count the cashiers drawer each day they'll be able to see if there's extra cash in the drawer. As a former manager when working through college I can tell you that mistakes do happen, and most are honest and thus caught when the drawers are counted. If there's a camera looking at the register then they also might be able to see what you gave her, but even if there's image there's no promise they'll be able to see how much you gave her.

A second Felony while on probation?

My daughters bio father has a felony right now. (I don't think that it matters what 4) He was put on probation for 5yrs. He is do 2 get off of probation in about 1 1/2 years. But the other day him and I went 2 court 4 unpaid child support %26 it was filed as a class A mist miner. While I was there he was 45mins late so I got 2 talk to the state prosecuting attorney alone she says she wants to dismiss the case and go with a felony. I said ok. He later showed up but neither the prosecuting attorney or I told him that they were going to refile it as a felony She just told him to pay the support 4 that month. She asked him were he was living he answered but refused 2 say who he was living with. She thinks that he is lying about his address which he had 2 report 2 his PO or he is violating probation. He has violated probation twice before. The 2nd felony I know will be another Violation b/c he's already on probation for a 1st felony. %26 if he is lying about his residence that would be another violation. My ? is once they pick him up for his 2nd felony. He will have 2 go 2 Jail until some1 pays bail 4 him he will then have 2 go 2 court 4 violating the 1st probation (I don't no how many violations this would be 4 him I no at least 3 maybe 5.)WILL THEY MAKE HIM SERVE THE SENTENCE THAT HE COULD OF SERVED IF HE WASN'T PUT ON PROBABTION OR WILL THEY AT LEAST PUT HIM BACK ON PROBATION 4 AN EVEN LONGER PERIOD OF TIME OR WILL NOTHING HAPPEN? Probation is far different from parole. When a person violates their parole, they can serve up to the remainder of the original sentence. When probation is violated, it can be far worse as the person is "re-sentenced" on the original crime. For example, if a person is convicted of a felony on a charge that carries, say, a ten year maximum sentence, and he is given probation instead of jail, that is usually a good deal. However, if that probation is violated, he or she can be re-sentenced up to the maximum allowable sentence. Sentencing guidelines do not apply in probation re-sentencings nor do double jeopardy implications. Also, if he gets a jail sentence for the second felony, it can be imposed consecutively to the new probation violation sentence, meaning that one will have to be completed before the other is started. This could equal a very long time.
If you don't want your daughter's bio father away for many years, I would suggest not aiding the State's Attorney as much. Certainly the father has a responsibility to pay what he owes. But this Attorney seems really shady and unprofessional. Once the sentence is handed down, there is very little chance of going back. Think this through. Good luck.

Do you mean the house is a mess or that the paperwork for it is a mess and that you dont know who owns it ?

If it is the latter, then the executor should put the house on the market and the Equity company will have a contract (there should be a copy in your relatives possession) which will state as to how much they are entitled to from the sale of the house. It could be as much as 50% but it will depend on the contract that your relative took out with them.

The executor should get in touch with them straight away so that you know where you stand.

So in August 2006, I went on a cruise to Alaska. My aunt is watching over my house for me. While I am gone, my cousin comes over, and takes two of my video game controllers home with him, and doesn't tell me. When I ask him if those are mine, he tells me that he bought some too, so I believe him. Then, in April 2007, I get suspicious, and ask him if they are really his. He then confesses and says those controllers are actually mine. So upon return, I plug them into my video game system, only to find out they are broken. I'm 16 years old, is there any legal action I can do to get compensation?

Unfortunately these things happen. My little cousin once ruined my collection of Ty's. But it is family. The controllers are not worth as much money as it would cost to take legal action. Plus It would not be advisable to because it would put hardship between the families. I would just talk to your mom and dad. life is to short to fight over the small things. Even though they seem really big to you now, it is not worth loosing family over.

I would have a talk with your Aunt, and ask her if she knows that your cousin took, your contollers, and broke them, and if she is aware of this, then tell her you want a replacement. Yes you sue for what is called conversion. This is when the item is taken or made no longer useable by the rightful owner. In this case the defendant would owe the market value of the item. As a 16 year old you would have to have a parent or gaurdian sue for you....but in this case we are taking about maybe 50 to 70 dollars worth of property...the filing fees would be about that amount...probably not worth it...especially if you lose.

I applied for Social Security benefits in December and recieved a call from the SS office today. The woman told me I was approved for benefits.

My step daughter receives SSI and they called us to let us know she was approved and then a few days later we received a letter in the mail stating the amount she would get each month.

If you indeed have been approved for benefits, you will get an award letter in the mail informing you of any back amount and your current monthly amount. If you do not receive the information within two weeks, you should make an appointment to see your case worker.

You probably will get a follow-up letter. Yes, they do normally send a letter. A copy of it goes into your file, for verification purposes. It really doesn't make a big difference, anyway, because you still don't get the benefits until they get around to starting them. But they should also tell you what date they list for your "start of disability." Then the first benefit check should be a lump sum, retroactive to that date. So either way, you still have to "hurry up and wait."

A print vendor printed my project without written consent / approval. What are my legal options?

A print vendor was selected to print my project. I approved the proof (with signature) and requested verbally to attend the press check. However, the printer completely printed the job without notifying me of the press check. To make matters worse, there were design errors on the project. The vendor is wanting full payment, but I stated I would not pay due to not providing a signed agreement to go to press without my presence. Who's right? What are my legal options?

if you remembered to patent the piece then you have recourse. refer to and/or retain a lawyer.

You don't say who made the design errors. You don't say whether your approval before the print run was an express part of the job or whether it is generally done in your business. In my experience approval of a proof is generally is a "go" signal to the printer. Suggest you talk to a lawyer to whom you can show %26 explain all the facts.

I was sitting outside the bar on a bench and two cops drove up because someone reported an intoxicated person outside. I was just sitting there but I was very drunk. I was just going to walk home but it was preety far. Could he have arrested me if I wasn't being a disturbance, I was just quietly sitting there? One was kind enough to give me a ride but he did take my license and wrote down the info. on it. He knew me because I worked at a gas station he frequented while on duty. Why'd he write down my info.? Should I worry about this? Or is this normal protocal? I'm glad he didn't arrest me becuase it is so wrong if someone isn't making a disturbance and is of legal age and WAS NOT DRIVING.

Many patrolman have to keep a log. He, more than likely, just took your information down to enter into his patrol log. The log would read that he responded to the call and found you sitting on the bench and gave you a courtesy ride to your residence. Some places may do an informational report saying pretty much the same thing. If you was going to arrest you, he would have done it at the bench outside the bar.

Cops like to document everything they do. Sometimes its to cover their bum and sometimes its to gather evidence against you. If he had to write a report regarding the call and what he did it would be dumb to say he gave a ride to a stranger and not be able to say who. Unless I'm driving or need ID to buy alcohol, I try not to carry ID. Why should I?

I believe some areas have public intoxication laws, but most likely he was documenting the who, what,and why of what he was doing during that time period for the record.

It is normal to write down every person we come in contact with. All sorts of crimes have been solved this way. If you committed a crime and someone came up and said you frequented a certain place it could help. If you were found with no ID it could help that he had your name on file. After you left the car he may have ran a warrant check. He may have taken your name down because it is his department policy to write down every person he transports. Or, he may have been worried you would say something inappropriate happened and wanted to ensure that he had your name just in-case a complaint was made... You could have also been cited for public intox, you admitted to being drunk. I assume that you weren't because you said this officer comes to your gas station...We like our free coffee.

In my opinion it's just procedure. I witnessed a car accident one time and they took my driver's license information... I'm certain it's along the same lines. Just keeping track of who they came into contact with and what they were doing on the government's time.

If she is a ward of the state, more than likely she has been in some type of state facility to be deemed as such or she is currently on welfare. Still the state does not have authority over this woman's having children; but they do have the authority to take her children if she is unfit to manage them. Her actions as being a person devoid of morals or ethics is not enough to normally deprive her of her civil rights. I wouldn't get into a contest with this individual over things you see as morally incorrect, it would be a better choice to let the authorities handle this situation so you don't stir up any unnecessary trouble for yourself, that may have been avoided.

As to her continuing to have children, the U.S. does not (yet) arbitrarily sterilize people. You can access criminal records, but not medical records. I'm not aware of the hippa laws. Well under the law in England and Wales a pre nuptual agreement is not legally enforceable but may be taken into consideration.

The area of law here would be equity law. You may not have a legal interest but it can usually show an equitable interest.

This means if one partner pays the utility bills and the other pays the mortgage an equitable interest may exist for the one paying the utility bills because a contribution to the upkeep of the property can be shown.

I think you will find that you were informmed by advert in your local rag. This is standard practice when public opinion is required with regards to building reg's. It's not the council's falt or your neighbours if you don't read the public notices section of your local news paper.

Why has it taken you three years to do this - shouldn't you have done something sooner. Write to the council but I would imagine that it is unlikely that you would be able to have it removed.

Where do you live? In the UK planning permission must be obtained for any building which extends the original by more than a certain percentage. Also planning permission is generally not given for building work which would block light from neighbours if the said extension falls within 45 degrees of a window and is within a certain distance of the neighbours house.
Having said this, it differs from area to area and there are local bye laws which can come in to action.
Generally, any building without planning permission which is less than 12 years old could be subject to a demolition order. You need to contact your local council to check if permission was granted etc.

I would imagine the council were giving you the chance to object to planning permission, and as you didn't, it was granted. Your neighbours were then legally allowed to build their extension.
If they built outside the planning application, you may have grounds to object on that basis, but not on the original application as it went through.

In the UK there are certain permitted development rights for householders to build extensions, erect garden sheds, garages and the like or to put up boundary fences. There are of course restrictions on height and volume but if these are adhered to then no planning permission is required. Where this occurs a neighbour has no right of objection. Sounds a bit harsh but that is the way it is I am afraid.

When a development is to exceed the permitted development rights then an application should be made to the Council and thereafter the neighbours should be consulted to ask for their comments within a specified time (usually about 3 weeks). The decision will then be made and if approved, neighbours have no further rights to object or appeal, unlike the applicant who could appeal against a refusal.

It is not unusual however for a householder to simply have an extension built which exceeds the permitted development rights without seeking permission. Many get away with it because the Council do not know about it - extensions are usually built at the back of houses and are out of sight. Once such an extension has been up for 4 years or more it is then immune from action and becomes lawful by default. If you want to check on the status of the extension you can speak to your Local Planning Authority or get a competent Planning Enforcement Consultant to check it out for you. It would be less than a couple of hours work for a professional and probably cost around a hundred pounds. At least you will know for sure. Hope that helps

I just moved in a brand new house, and my lot is about 20,000 square feet. My neighbors lot is about 14,400 square feet, but he's built his fence over the property line and taken about 3500 square feet of my lot. I'm going to have my land checked out by a surveyor for exact details --- it's a huge amount. I'm going to ask my neighbor about it soon, and maybe he'll just move his fence (he's build a huge playground and a big rock-well in the space, so I'm not sure if he'll want to), but I'm also okay just selling him the triangle peice of land as well. If I was in your situation, I would inform the neighbour about the problem first. I would also inform him/her that they should be responsible for at least half of the cost of the surveyors fees, and then start to negotiate on the selling price of the land that they have fenced in that is actually yours. I recommend that you don't sell for anything less than the going rate per square foot of land-no sense in you loosing money AND land, is there? A good price would be at least $25 per sq. ft. If the neighbour does not want to pay for the land then he must remove the fence from your property himself, or you will have it done and send the bills to him for the work. I'm sorry if that inconveniences your neighbour and his need to move the playground a rock-well area, but I guess he should have had a survey done himself first. Good luck!!

Changing your property's configuration may violate zoning laws and make it impossible to sell your property. Just a ball park answer for a ball park question. If you are working for a company and you put your two weeks notice, the day you do this they tell you don't worry about coming back. there is a homeless who collects cans, and once a while he goes around my neighbood to collect them. Well today (I was alone at home), luckly as I went to grab a cup of water, I saw him through the window carrying my skateboard and my dads chainsaw. The executor to any will made by a deceased Hindu will file petition for probate %26 letter of administration under the Indian Succession Act, 1925. Section 30 of the Hindu Succession Act, 1956 clearly provides this %26 so does section 57 of the Indian Succession Act. All matters in respect of probation %26 issue of letter of administration are covered under part IX of the Indian Succession Act. The Hindu Succession Act provides for the general principle of succession in case of Hindus who dies intestate (died without any will) but the Indian succession Act provides in details the whole process of succession in case of every Indian citizen including Hindus with respect to wills, codicils %26 other such related matters.

In the U.S. if a person dies with a Will, the property will be disposed of according to the Will. Rarely does anything else matter to the Courts.

Her husband has a farm that she now toils alone. Before the husband died he would tell her often that all his property will be hers if he were to die. The kids have never been interested in the farm, until that is they hear rumors that it is worth a lot of money. Now they want to claim their share according to Hindu Act and want their mother to sell the land so they can profit from it. There was no will by her husband, the father, but at the time of his death noone wanted a share and only the mother's name was registered as owner of farm. She has another small piece of land that has little value and a house of little value. Both were in her husband's name until he died. None of the kids want to claim a share of this property since there is little to be gained for themselves.

So, all of them should come to a mutual understanding and prepare a joint memorandum of understanding of private partition under Hindu law, and submit the same to the revenue authorities, for splitting the patta and khata, obtain individual mutation orders, pay tax, and update their respective records . If disputes persist, they can by mutual agreement, appoint an arbitrator, under the Arbitrator and conciliation Act 1996, and submit the issue of partition. The third one is to approach the civil court of competent jurisdiction, for partition.

As for the other issues are concerned, they are irrelevant to the issue of property partition. However, if the lady, in the meanwhile, is in need of maintenance, she can file a case under section 125 of the Criminal Procedure Code, against all the four of her children or any of them, depending upon the paying capacity. Unfortunately, you'd probably have a difficult time proving that he guessed your password and that you didn't just give it to him.
You could make the school aware of what happened and then consult an attorney as to what could be done.

First: What he did was illegal.

Second: You don't really need to prove that he guessed your password, only that he has a copy of your transcripts. Where did he use the computer to do this? If it was in a library, that makes it much easier as that there are monitoring systems in most libraries (both computer and camera) that could have caught him in the act.

I suggest that you report it to your school authorities first and then to the police. I'm not sure how your school is organized (I'm assuming you're in college), however at my college - I would start with the student life or security office. And then make a visit to the help desk and get your password changed to something secure.

My son has written-off his car in an accident involving no other vehicle, personal injury or property damage and he has only 3rd party insurance. His car was removed from scene via police recovery and is in garage storage yard. They want him to pay before he can remove it and are adding daily fees all the time it is there. He is unemployed and in the process of going bankrupt with a final appointment to sign forms on monday at CAB who have been colating his debts and writing to his creditors in preperation for this. He has no money at all so cannot pay fee to remove the car (which was of little value and a write-off) or the mounting charges. How can he resolve this or halt the fees? Will this be automatically included with his other bankruptsy debts?

I don't see why he would need to pay to get a wreck out of the garage. The CAB should know what is the best thing to do. I think all debts are written off when you go bankrupt, even this one. I don't see how they can enforce these charges if he doesn't want the car back.

It may be worth just checking first with the insurance your son has to see, sometimes they can be quite accomodating, depending on the circumstances of the collision.

Failing that if the car is written off and of little value anyway I would contact the garage and see if you can sign a disclaimer to surrender the car to them for disposal, they will normally charge a nominal fee and you sign the V5 over to them for scrapping.

This should not be included in the on going bankruptcy as it is as yet an unregistered debt.

it could be done sooner if he were to just go down and sign a release and hand over the title. he would still be liable for storage fee's so yes that needs to be added to the bankruptcy debts. In this day and age bankruptcy doesn't mean he will not have to repay. it does mean he will be given time and a fair repayment schedule

If he doesn't want the car, I would suggest to sign the title over to the garage and tell them that he is surrendering the car to them because he can't afford to pay for it. As for putting this on his bankruptcy I have no idea, ask the lawyer.

Anyways to answer your question- your friend violated license restrictions. The insurance company wasn't "notified", rather a flag showed up on your friend's file which is monitored by his Insurance company's computers in order to keep tabs on raising or lowering his premium. Since his violation is based on restrictions to his license, it is a provisional license, and it was not a simple moving violation WHILE SUPERVISED- this is why his policy was cancelled.

Although the company did not go into liquidation, she has still not received the 1 month's wages owed to her. How can she claim these. She has telephoned head office several times to no avail. Is there a government compensation scheme that she can claim from or should she take this firm to the small claims court to get her money. She is also still awaiting her P45

The obvious solution is not to call them but to write to their head office clearly stating they owe monies out. Enclose hours worked or salaries due.

If you get no reply, write again stating you will be taking legal action against them to recover the monies owed, its a good thing for you're friend they havnt gone bankrupt, as the creditors are legally entitled to take their money 1st.

Should you still get no reply (and you should as at this stage its a bluffing game), then pass the information on to either a debt collection agency or take it to the small claims court with/without a solicitor (I find you dont need them at all).

Did the executor of the estate that she inherited from sell the house? If so, then they have to account for where the funds went.
Due to her advanced age, did she give someone else power of attorney on her behalf? They may have access to her money, and may have "invested" it in something that is not in the best interest of this woman.

Your country court has records which reflect both parties to this sale.

I suggest that you check the Property Records there and ascertain which party represented the seller in this matter and then go on from there.

Try land registry, they might have the new owners and you could possibly trace the estate agents or solicitors from there. You could also go to the house and make some enquiries there. Good luck.

Thes best way to go is to start from the sale. First, the real estate agent that list the property. She should know something. If no agent involved, then the buyers. Buyers should know whose they paid the money to or accepting the money on behalf of your friend. I think the easiest of all is to talk to the buyers, because they must be the current owner and it is the easiest person to locate. Once you know who present at the closing of the sale of the property, you can find out the person accepting the check.

The other person you should ask, if you can find out, the Lawyer who handle the transfer of the property. He or she should know the people at the closing. If not, the lawyer should have records and documents of the transaction. In your case, your want a copy of the cancel check written out to the seller. Once you have a copy of the cancel check, you can see in the back the bank or place where it was deposited or cashed. You then go to the bank and ask for the account records. From the bank account records, you should be able to trace the money. You can also find out from the account the name of the customdians, trustees or the person authorized to write check for your friend. Once you do all this, you should be able to find out what happen to the cash.

It is a little work, but you can do it. You can go either way. Start with the buyer is the best. He or she can tell you the lawyer, the real estate agent, the buyer agents, or any one that involved. You may want to try a small law firm because you get more personal service. Also, you need to treat an attorney as you would an employee, interview them. No, since its the truth. Also most companies do keep records of that in case the employee has to be let go in the future for the same offense. I am in the transportation industry and if a driver fails one we are required by law to tell every prospective employer that calls for a reference that the driver failed. Maybe he could talk to his boss about getting rid of that at some point but I doubt it. Part of the reason we as managers keep track of stuff like that is so the employee cannot fight for unemployment if ever let go for a repeating offense. Every time I speak to an employee about attendance or time off or any problem, I write it down and keep it in their file. That is protection for me so he can never come back and say he wasn't aware.

Depends on how the other person found out about the drug test. If he is on probation and is required to follow the typical probation/parole prodacal then it can be considered public record. Though typically results of UA's are not public notice unless your friend was charged with a PV (probation violation) which makes it public record. Any and all criminal information in public record. If you live in a county where it's easily accessable then this will be a common to find out. For example the county I live in, they have 7 computers for free/public use at the court house. Anyone who has ever gotten a ticket, or been charged (not necessary even have to be conficted, if they are even arrested) then it is public record. I could go in and type anyone's name in and it will give me a list and details of any charge/arrest/or ticket given to that person.
If this is something your county has, then it would be very easy to find this information out and no law has been broken.
I would advise your friend however go to their supervisor and complain that he feels he is being harrassed.

While some may consider drug testing, credit checks, reference checks, and other pre-employment checks to be Gestapo tactics, they are a requirement for many companies. Your signature on that document is what gives them the right. So be ready to live up to the terms to which you have already agreed. An example of this “condition of employment” clause being invoked occurred when a recently hired grad was found to have lied about some information on the employment application. There have been numerous cases of graduates who have been hired and then fired by the new employer based solely on the conditions of that document. And sufficient second-hand smoke exposure can also cause failure of standard urine drug tests. You could fail both a primary and secondary test, with no recourse other than saying that it was someone else. It’s just not worth the risk.

So if you have been exposed to illegal drugs, your best insurance for a clean drug test is to stop using them immediately. And not just temporarily—permanently. Drug test or no drug test, using illegal drugs (and excesses of alcohol) will eventually catch up with you—sooner (if you are foolish enough to use them during work hours) or later (if you obliterate the rest of your life outside work).

Some drug testing companies will either have a doctor (or other medical professional) personally interview those who fail a drug test to determine if there was a potential false positive.

If you do receive a failing grade (actually referred to as a “positive” on your drug test—this is one test you do NOT want a positive—you want all negatives) on your drug test, ask to be retested with a confirmation or secondary test. Many employers do not automatically perform the confirmation test since it is significantly more expensive than the initial test. However, if they are unwilling to offer retesting due to the expense, offer to pay the expense on your own and then use a different testing service—ideally a secondary testing provider recommended by the employer so that you won’t have a credibility problem with the second test. My maternal grandfather was born of Canadian French parents. While he was born in the US his parents spoke only French to him and his brothers. They died when he was only 7 years old. He went into an Catholic orphanage where the nuns refused to speak French to them. It was amazing, according to him, how after their first day of whining and carrying on in French that they were able to learn English and very quickly. Of course had there been a real problem and someone needed to speak to them in French there were some nuns who could but they were in America and so they spoke English. I wish those coming across our Southern border would learn English instead of expecting everyone else to learn Spanish.

Is this because there was no will If so I would suspect that just incase the children are not of age there would have to be an adult to act as a trustee - the money could be put into a trust until the children are of age. Im not really sure but did find this information

If a Doctor can issue a death certificate i.e. there are no suspicious circumstances then the body can stay in the house. There is no law stating how long a body can remain in a house for, or stating that it has to be removed in a certain time. You do not even have to use a funeral director.
If a death certificate cannot be issued i.e. the Doctor thinks the death needs further investigation he will contact the coroner who will arrange removal.
In practice, if a body had been left for days by relatives without informing anyone the coroner and police would investigate in case there were suspicious circumstances surrounding the death which relatives were trying to hide, but they wouldn't have actually broken a law by not informing anyone sooner.

It would really depend on the circumstances. I dont think there is a set guide line but a coroner is usuallt called within the hour and an under taker will take it away as soon as they are able to attend. However if there are suspicious circustances ie murder etc then it could take longer as csi would need to attend and photograph the body etc!

If you can prop them comfortably in a chair you could have them with you for ages...if you don't mind the smell. It does help to embalm them though as this would remove the quickly degenerating organs and treat what is left with a preservative.

In the uk the body does not have to be removed from the house until burial If the doctor says he/she died of natural causes. Even then the body doesnt have tio be removed from the grounds if you have a garden bug enough to bury it and get the right planting permission from the council!

I don't think there are set laws on this but most people have them removed within a couple of hours of a doctor pronouncing that they are actually dead. The smell of a dead body really isn't nice. Not how you would want to remember a loved one for sure.

When I watch FBI Files or Forensic Detectives, they normally take them away straight away unless its an actual crime scene in which case it would be a lot longer.

Seeing as your describing a natural cause of death, they would take the body straight away. However seeing as the family kept the body overnight, I don't think it would cause any trouble. The police would be sympathetic and understanding to their grief.

Whether it is expected or not any death not inside a hospital has to be reported to the police, who in turn report the circumstances of the death to the coronor, who will in turn issue a certificate of death.

Some people do find it hard to accept death and calling undertakers/police or ambulances is the last thing on their mind, although once the death has been reported the police can enforce entry and removal of the body.

There is no specific law that gives a time window, but for obvious reasons as soon as practicable would be best for everyone concerned.

From experience some just cant accept the death of a loved one and bodies have been discovered months after the death in very advanced stages of decomposition and the elderly partner was still sleeping in the same bed as her deceased husband about 6 months after his death and didnt register the fact that he had almost turned to liquid and the smell was over powering.

Is there a professional medical list of doctors provided some where so people (you %26 I) can know when we go looking for a family doctor or chidren's doctor we will know who we are dealing with?

Hopefully, (when we go for an office visit) we all have doctors who are treating us and our dear family members safely in one part of his/her day and not killing our communities children in another part of the day.

There are many, if not most, hospitals that refuse to do abortions. This is why separate clinics are set up mainly by Planned Parenthood. My mum has been married to her husband for almost 2 years. Anyway, once married this man changed totally, became a different man altogther so they are now divorcing. All through the marriage he refused to give her any money, she only had child benefit to live off which brought her and her sons food each week and any clothes ect Today she has just come across a bank statement which shows he has been putting all the extra income, meant for the family, into an ISA. Does she have any rights to claim some of this as it was the families money in the first place? It is quite alot of money.

Its really down to a judge to decide. This is a matter of equity and trust law. Most good divorce solicitors will be reasonably up to date with Equity and trust law. There are a number of leading cases that cover this type of scenario.

Asa far as the ISA is concerned there may be a case for a constructive trust here as it is alleged that the funds are for the family.

that's illegal...go speak to an attorney..and second of all you need to tell them to not contact you anymore and legally they have to but that doesnt stop them pursuing the debt and really if youre still paying they cant do anything...i had the same issue and i did what im telling you to do and it stopped...if youre able to try and call them to make a settlement offer which can be 50 to 60% less of what you owe but it requires you to have the amount agreed on immediately to pay off..hope this helps and dont stress too much..

I have quit paying on 5 credit cards totaling $5,000.00. They call and call but I leave my answering machine on 24/7. Yes, my credit rating sucked for awhile but who cares. I own my home and car and don't need or want any more credit, especially credit cards. Earlier this morning I was working on my uncle's farm. In his farm he has sheep, chickens, horses, etc. While i was brushing his dog One of his sheep broke out of its pen and ran off. By the time I found him he was causeing havoic in a local grocery store. He got into the store and wrecked this really big bananna display that was by the front door. HE ate and vomited up all the banannas . My question is how much trouble can me and/or my unlce get into with the grocery store? And also can we go to jail or get sued? Only serious answers only.

As far as "trouble", I don't see any criminal intent so I would have to say no from a law point of view, but civil responsibility is the real issue here. Your uncle is responsible to maintain control of his livestock and the grocery store owner has every right to seek actual damages. If the damage was limited to eating a banana display and making a mess, I would think that a local farmer and a local grocery store owner ought to be able to work out an amenable settlement.

I would think that you would be liable for the damages to the store but I don't think it could be a criminal charge though I am not sure what country you are in, maybe Australia or NZ. I think it would be fair to pay for the damage, at least reasonable damages.

You/your uncle, as owners of the unruly animal, will be held accountable for the damaged display, fruit that was destroyed or damaged and the clean up involved.

Depending on the exact situation, there is no such law that comes down on adults for fighting with minors. Now the fact that this minor is so close to age 18 makes a big difference compared to an adult defending themselves against a 9 year old (given that they don't have a weapon). You can always defend yourself, no matter what the age of the other person. However, you will both probably end up in court pleading your case. Allright so Ive been fighting with my cousin over this will somebody let me know if im wrong or right. When my cousin was like 15 she got cought with a friend at abercrombie shoplifting %26 nothing happened to her but she was just told to never come back to an abercrombie store ( perhaps because she was a minor?) its been years now %26 she was there one day %26 somebody ofered her a job %26 shes going in for an interview next week. I would bet that there is no record of her being "banned" from Abercrombie. If several years have gone by, that info is probably long gone. Also, she was a minor, so if that info was to show up anywhere, she could probably explain it to the people that she was young and stupid, etc. I think she ought to go for it. The worst that could happen is that they don't hire her and she gets embarrassed.

Not all stores maintain a list of shoplifters for more than a year. Think how long it would be... SInce she was a minor, she should be all right. The never come here again is usually an empty threat, unless they were formally charged.

I doubt they keep detailed records of all the shoplifters they let go, but I could be wrong. If someone offered her a job, and she wants it, it's worth trying. If they do figure it out, so what? She's right back to where she was, no harm done. They catch people shoplifting all the time, plus the store probably has high turnover. I doubt the same people even work there, if it has been years. Even if they do have a long time employee, do you think that person will really remember her?

You can file a FOIA (Freedom of Informarion Act) request to see if you qualify to get copies of the calls assuming they still have them.

I am a 911 dispatcher, so I may be able to help with this. I know in our dispatch center, actual calls are recorded, copied onto CD's and kept for a period of several months. I can give you a personal example of when a 911 call helped. I was behind a drunk driver one day. I called 911. A land line phone will show the address, phone number, and the name of the person registered to the phone. I got this number from a yahoo news article. It said in NYC there were 590 gun deaths /8 mill people. In the Uk there were 45/53 million people.

Do you think these laws should be extended on account of the growing anti-social and criminal gang culture spilling out onto the streets in Britain? For example there are huge gangs of youths who hang around in my street and they are often abusive and threatening. I know elderly people who are afraid to leave the house. I've seen them pick on lone people trying to walk their dog or get to the local shops.

Recently we've began standing up to them and have had a group of them with weapons enter our garden threatening to assault us. By the time the police get here they are gone and difficult to identify as they dress the same and wear caps. We are advised that even although these youths enter our property, hugely out-number us and wield weapons (including blades), we would be prosecuted should we also attain weapons and proceed to defend our property and ourselves while we await the police to attend. It is fraud on the part of USDA and FDA. More fraud! While they aren't inspecting foreign meat they are demanding that anyone who houses even one livestock animal register their premises, tag their animal(s) and eventually be required to report all animal movements. This onerous mandate is called the National Animal Identification System (NAIS). They say it is about disease control, but if that were the truth, they'd be inspecting every food item that comes into this country.

It is not possible to inspect 100 % of it.

The law should be changed that they can do much more than visually inspect the food, like for example they could force producers to inspect and test their own food and report the results.

The FDA could then focus their limited resources on performing audits of those tests to ensure that they are being conducted and reported accurately.

Or a law could be passed making it easier for a private citizen to sue a food producer for selling tainted food. Rather than the laws now that only allow the lawsuit if the producer "knew" it was tainted. Now they can just say they didnt' know becuase the producers are not legally required to test the food or make the results of their internal tests public.

I signed a year lease and its 5 months into it. And part of the lease was if you break the lease early you have to pay a months rent extra. I also paid a $300 deposit. It鈥檚 very noisy where I live. I complained to the landlord once and he didn鈥檛 do anything about it and I have called the police out there eight times within the 5 months. Still nothing. I have been looking for another place b/c I literally can鈥檛 get any rest. I found a place and plan on moving next week. I called the landlord to tell him this morning I was moving next week. He said well we will make arrangements to pay the extra rent for breaking the lease and also he would need to come check the place for damages and if there is any I will have to pay for that too. I don鈥檛 think I should have to pay for breaking the lease b/c I complained and nothing was done about it, its part of his responsibility to take care of his tenants...correct?

First of all, since there was a lease you are technically responsible for the next months rent. However, when it comes to the security deposit, he/she cannot withhold your security. What they can do is inspect the property and any damages that were made, they must provide proof of repair, such as receipts and stuff, and attach it to the remaining deposit. They have 30 days to return your deposit or tell you where it is. In most states, the landlord must put your security deposit in an account, where it accrues interest. They are supposed to attach any paid receipts to the deposit, which will be returned.

Judges usually don't side with landlords on this one, especially since your willing to pay that extra month just so you can leave. In the event that the landlord doesn't return your deposit, then you can file a complaint in the small claims court in the county where the apartment is in, and most likely the judge will award you 2x your security, if they find the landlord was withholding your security.

Really, you have to pay that month because technically you are responsible for all the months that apartment goes unrented up until your lease is up, given that the landlord tries to rent it out in all ways possible. So if I were you I would pay that other month or possibly get sued for the remainder of the lease.

It actually shouldn't matter if you don't do this because that would be considered normal wear and tear, but just in case your landlord is a jerk then you won't have to deal with it. Make certain the place is cleaned, too. Take pictures of the final result if you can, so you have them in case of a dispute. The only reason you might not get your full deposit back, then, would be if you didn't give enough notice beforehand (some returns of deposits are contingent upon at least a twenty day notice by tenant before moving).

Your landlords responsibilities don't extend to keeping the neighbours quite. If you were promised a quite lodging before moving in, however, then you might have a case for breaking your lease without expectation of reprisal, but only if.

Banning it wouldn't do any good. Look at all the deaths each year related to illegal drugs. People will still get it if they want it. Moonshine is illegal (but I think now it is starting to become legal in a couple of states but is high regulated or something like that, I don't know, that's not where I live), but people still find it and drink it. I don't think it's an issue of legality. Rather it's an issue of how our sick society effects kids. Young people (and some never grow out of it) feel a strong sense of importance in fitting in and being popular and desired. Drinking like that is supposed to mean you are "the life of the party", "always fun to be around", etc. This is what these kids want. In fraternity hazing, too, it's done as a means of being accepted into that organization. Our kids need to be taught better. Popularity isn't worth losing your life. People get drunk beyond reason, they get stupid, and bad things happen.

Drugs are illegal and look how easy they are to obtain. Banning does not work, the 21yr old drinking age does not work, abstinence education does not work, etc. etc. Until society as a whole changes itself no law or ban will stop people determined to do what they want to do. It's a common area, so all tenants have the right to use it. Now, the landlord may require them to maintain it since they are on the first floor. The details should be in the lease.

I'm not sure why you care that the yard got cleaned up. You should know better than to believe another tennant when it comes to issues regarding the property.

My guess would be that the yard is a common area. However, if you haven't been taking care of it, then the landlord may be entitled to give these people full use of it providing they do care for it. If your lease doesn't say anything about the yard, then I'd guess that you are just renting the apartment and nothing else. Perhaps the landlord has made other arrangements with the new folks. Did you ever ask about the yard before? Maybe they did.

Because you refused the breathalyzer and this is your second offense, you're subject to administrative license suspension for a period of two years. The reason they can do this is because having a driver's license is considered a privilege, not a right.

I had just heard on the news that the government passed somthing that said that come January 2008 if our TV does not have HDTV we will not be allowed to watch, I assume it will not work on our television? Does anyone know if this is true or not.

In the US, the FCC is pushing for a shift from analog broadcasts to digital broadcasts. Most cable and satelite providers have already made this shift, but over-the-air broadcasting is still in transition.

The move to all High Definition Content is coming, but it is still a few years away.

This DOES NOT mean that you can't watch TV, but it does mean that your old, analog television won't be able to receive the digital, over-the-air signal unless you buy a converter. A converter may be reletively expensive at first, but the price will drop and demand reduces.

If you subscribe to cable or satelite, you, most likely, already have a converter that came with the service. If you rely on a rabbit ear antenea, you will eventually have to buy a new television, or a converter.

That's the most ridiculous thing I've heard in a while. If you don't own an HDTV you can watch TV? lol.

At 16, I never had the time to get my license cuz I was busy going to school and working 2 jobs to support my dying grandma. When she died, I was 18, forced to live in her car, and was unable to get my license due to the time I didn't have. I was soon pulled over after my grandma's registration expired. I was given a ticket for driving w/o a license, not being insured, and not having registration, but let me keep my car due to my situation. I went to court, and was given a fine that I couldn't pay. I asked for community service but the gal at the window told me it would be better to just pay it. Within that time, I was unable to get my license because I owed the court the fine, but I continued to drive. Soon, some1 hit my car, and the cops came. The cops asked for my license and registration, and my car was towed away, and I received another ticket as I moved on to the street. I'm 22 now, still struggling, have 2 warrants because I couldn't pay the fine or get the 2nd notice.

If this can be handled by payment alone, and if you have the funds, you may be able to take care of this through the DMV. If not, or if you do not have the money, you should go to the courthouse, and speak to the Public Defender there, so you will have an attorney when you go to court. If you voluntarily surrender to the court, it is unlikely that you would be sent to jail for this kind of problem.

For future reference, you cannot be put in jail for failing to make payments if you do not have the money. You can be put in jail for not making your appearances. So if you cannot pay, always appear and tell the judge. And never take legal advice from a clerk at a window.

If you don't have any money or any place to live, maybe you should join the military. I'm sure you can work out a deal where you get no jail time in exchange for enlisting.

The military isn't great but at least it will get you on your feet.
